By using MacTalk, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with these terms, you are prohibited from using MacTalk.

We reserve the right to modify these terms at any time. Your continued use of MacTalk after any changes constitutes your acceptance of the new terms. We will notify users of material changes via:

- In-app notifications for significant updates

Grant of License
Upon purchasing MacTalk from the Mac App Store, you are granted a non-exclusive, non-transferable, perpetual license to use the application on:
- All Mac computers owned or controlled by you that are signed in to your Apple ID
- Up to the maximum device limit set by Apple (typically 10 devices)
License Restrictions
Your license is subject to these restrictions:
- No redistribution: You may not sell, rent, lease, sublicense, distribute, or transfer MacTalk
- No reverse engineering: You may not decompile, disassemble, or reverse engineer the app
- No modification: You may not modify, adapt, translate, or create derivative works
- No circumvention: You may not bypass or attempt to bypass any security measures
- Personal use only: This license is for individual use, not commercial redistribution
Ownership
MacTalk, including all content, features, and functionality, is owned by MacTalk and its licensors. The app is protected by copyright, trademark, and other laws.

- Record others without their consent (where illegal)

- Violate any applicable laws or regulations
Account and Device Security
Since MacTalk does not require user accounts, you are responsible for:
- Securing your Apple ID and Mac devices
- Maintaining control of devices where MacTalk is installed
- Unauthorized access does not constitute breach by us
Compliance with Laws
You are solely responsible for complying with all applicable laws and regulations, including but not limited to:
- Local consent and recording laws
- Workplace privacy policies
- Intellectual property laws
- Content creation regulations in your jurisdiction

- Optional accessibility: Globe key features require accessibility permission
Consent to Permissions
By using MacTalk, you consent to:
- Microphone access: For audio recording (processed locally)
- Accessibility access: For Globe key detection and text insertion
- Automation access: For terminal app support (optional)
- Clipboard access: For preserving clipboard content during transcription

"As Is" and "As Available"
MacTalk is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:
- Merchantability: Fitness for a particular purpose
- Accuracy: Accuracy of transcription results
- Reliability: Uninterrupted or error-free operation
- Non-infringement: Not infringing on third-party rights
Transcription Accuracy
While we strive for high accuracy using state-of-the-art ML models:
- We do not guarantee 100% accuracy
- Accuracy may vary based on audio quality, background noise, and speaking patterns
- You are responsible for reviewing and editing transcribed content
- We are not liable for errors or omissions in transcribed text
Device Compatibility
MacTalk requires:
- macOS 14.0 (Sonoma) or later
- Apple Silicon Mac (M1, M2, M3, or later)
- We are not responsible for issues on incompatible hardware or software
đĄī¸ Limitation of Liability
Maximum Liability
To the maximum extent permitted by applicable law, MacTalk's total liability to you for all claims, damages, losses, and causes of action shall not exceed the amount you paid for MacTalk ($19.99 USD or equivalent).
Exclusions of Liability
In no event shall MacTalk be liable for any:
- Indirect damages: Lost profits, lost data, or business interruption
- Consequential damages: Special, incidental, or exemplary damages
- Third-party actions: Actions or failures of third-party services
- Content issues: Errors or issues in transcribed content
- Permission problems: Issues arising from denied permissions
Apple's Role
MacTalk is distributed through Apple's Mac App Store. Apple is:
- Not a party to these Terms of Service
- Not responsible for MacTalk's functionality or warranty
- The provider of the App Store platform only
- Your relationship is solely with MacTalk, not Apple

Our Intellectual Property
All intellectual property rights in MacTalk, including but not limited to:
- Source code and compiled application
- Brand names, logos, and trademarks
- User interface and design elements
- Documentation and marketing materials
Are owned exclusively by MacTalk and protected by international copyright and trademark laws.
Third-Party Intellectual Property
MacTalk incorporates third-party technologies:
- WhisperKit: Open-source ML framework (Apache 2.0 license)
- Core ML: Apple's machine learning framework
- AVFoundation: Apple's audio/video framework
We acknowledge and respect all third-party intellectual property rights.
User-Generated Content
Since MacTalk does not store or collect content:
- You retain full ownership of all transcribed text
- We do not claim any rights to your transcriptions
- You are responsible for ensuring your content complies with applicable laws

Termination by You
You may stop using MacTalk at any time by:
- Uninstalling the application from your Mac
- Revoking permissions in System Settings
- Deleting the app from your Apple ID account
Termination by MacTalk
We reserve the right to terminate or suspend your access to MacTalk if:
- You violate these Terms of Service
- You engage in fraudulent or illegal activities
- We discontinue the app or service
Effect of Termination
Upon termination:
- Your right to use MacTalk immediately ceases
- No refund is guaranteed beyond Apple's standard policies
- All licenses and permissions are revoked

Apple's Refund Policy
Purchases and refunds are handled exclusively by Apple through the Mac App Store. MacTalk does not process refunds directly. For refund requests:

- We honor Apple's refund decisions
One-Time Purchase
MacTalk is sold as a one-time purchase, which includes:
- Lifetime access to the current version
- Free updates forever (as long as app is maintained)
- No recurring subscription fees
- No additional in-app purchases

You agree to indemnify, defend, and hold harmless MacTalk, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a:
- Your use or misuse of MacTalk
- Your violation of these Terms of Service
- Your violation of any third-party rights
- Your violation of any applicable law or regulation
